 建築法拍板 新增第三方查驗制度

【台灣醒報記者譚有勝台北報導】為了提高建築物安全，行政院29日拍板通過《建築法》修正條文，新增第三方專業團體辦理施工勘驗及竣工查驗制度。內政部次長林慈玲表示，透過第三方專業團體力量，主要是對建築安全增加品管防線，確保建築物居住安全。此外，凡是1999年以前的建築物，面積達1000平方公尺以上者，重建補強後若未申報，依規可處罰6萬至30萬元。

因2年前2月6日高雄美濃地震與2018年同日花蓮大地震多棟建築物傾斜或倒塌造成人命傷亡，再次喚起國人對建築物安全的重視。為確保新建建築物設計及施工品質、強化既有建築物居住安全，行政院29日通過由內政部提出的《建築法》部分條文修正草案，送往立法院審議。

內政部次長林慈玲表示，本次修正草案引進第三方專業團體辦理施工勘驗及竣工查驗制度，除了加強整合安全設計審查制度外，對於強化施工勘驗及落實竣工查驗層面，增訂一定規模以上建築物，應由第三方專業團體完成施工勘驗及竣工查驗合格後，方得繼續施工或核發使用執照。

「經歷了花蓮強震的慘痛教訓，政府對於既有的建築耐震能力評估必須加速進行。」林慈玲說，內政部已修正建築物公共安全檢查簽證及申報辦法，強制建築物應辦理耐震能力評估檢查，凡是1999年12月31日以前登記的私用建築物，樓地板面積累計達1,000平方公尺以上，應辦理耐震能力評估檢查申報。

她強調，地方政府也應嚴加查辦有危險疑慮之建築，並且必須依照規定申報，重建補強後若未申報，依建築法規定處罰6萬至30萬元。

至於強制實施建築管理前建築物申領使照，林慈玲強調，供公眾使用的建築物，因發生火災發生機率與風險較高，容易危害民眾之生命安全，屋主應依規定申請核發使用執照，若是未依規定申請，且有一定規模的營業用途者，得處罰2萬至10萬元。
